This privacy policy applies to the use of the website and the services provided by Trustforce B.V.. The effective date of these terms is 14/05/2018, and with the publication of a new version, the validity of all previous versions expires. This privacy policy describes what data we collect about you, how we use this data, and under what conditions we may share this data with third parties. We also explain how we store your data, how we protect it against misuse, and what rights you have regarding the personal data you provide to us.

DATA PROCESSING

Below you can read how we process your data, where we store it (or have it stored), which security techniques we use, and who has access to the data.

WEBSITE SOFTWARE

WordPress

Our website is developed with software from WordPress, and we have chosen TransIP for our web hosting. Personal data that you provide to us for our services is shared with this party. TransIP has access to your data to provide us with (technical) support, and they will never use your data for any other purpose. Based on the agreement we have concluded with them, TransIP is obliged to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. Regular backups are made to prevent data loss.

WEB HOSTING

TransIP

We use web hosting and email services from TransIP. TransIP processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. This metadata does not include personal data. TransIP has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Based on the agreement, TransIP is obliged to confidentiality.

PURPOSE OF DATA PROCESSING

General purpose of the processing

We only use your data for our services. This means that the purpose of processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us, and we use this data to contact you later – other than at your request – we will explicitly ask for your permission. Your data will not be shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all obliged to confidentiality under the agreement between them and us, or an oath or legal obligation.

Automatically collected data

Data that is automatically collected by our website is processed to further improve our services. This data (such as your IP address, web browser, and operating system) is not personal data.

Cooperation with tax and criminal investigations

In certain cases, Trustforce B.V. may be required by law to share your data in connection with fiscal or criminal investigations by government agencies. In such cases, we are obliged to share your data, but we will oppose this within the legal possibilities.

Retention periods

We retain your data for 26 months. This means that we keep your profile until you indicate that you no longer wish to use our services. If you inform us, we will also consider this a request for forgetting. According to applicable administrative obligations, we are required to keep your (personal) data, so we will keep this data for as long as the applicable period runs. However, employees no longer have access to your client profile and documents that we have created based on your assignment.

YOUR RIGHTS

Under applicable Dutch and European legislation, you, as a data subject, have certain rights regarding the personal data processed by or on behalf of us. We explain below what these rights are and how you can invoke them.

In principle, to prevent abuse, we only send copies and copies of your data to your already known email address. In the event that you wish to receive the data at another email address or, for example, by post, we will ask you to identify yourself. We keep records of completed requests, in the case of a forgetting request, we keep anonymized data. You will receive all copies and copies of data in the machine-readable data format that we use within our systems.

You have the right at all times to lodge a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data in the wrong way.

You will then receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data to your known email address with an overview of the processors who have these data, stating the category under which we have stored these data.

You always have the right to have the data that we (or have it) processed and that relate to your person or can be traced back to you, adjusted. You can make a request to that effect to us. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to your known email address that the data have been adjusted.

Right to restriction of processing

You always have the right to limit the data that we (or have it) process that relate to your person or can be traced back to you. You can make a request to that effect to us. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to your known email address that the data will no longer be processed until you lift the restriction.

Right to data portability

You always have the right to have the data that we (or have it) process and that relate to your person or can be traced back to you, performed by another party. You can make a request to that effect to us. You will then receive a response to your request within 30 days. If your request is granted, we will send you copies or copies of all data about you that we have processed or that have been processed on our behalf by other processors or third parties. In all likelihood, we will no longer be able to continue the service in such a case, because the secure linking of data files can no longer be guaranteed.

Right of objection and other rights

In certain cases, you have the right to object to the processing of your personal data by or on behalf of Trustforce B.V.. If you object, we will immediately stop the data processing pending the handling of your objection. If your objection is well-founded, we will provide you with copies and/or copies of data that we process (or have processed) and then permanently stop processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies.
